Revealed: Secret plan to keep Iraq under US control

Bush wants 50 military bases, control of Iraqi airspace and legal immunity for all American soldiers and contractors

A secret deal being negotiated in Baghdad would perpetuate the American military occupation of Iraq indefinitely, regardless of the outcome of the US presidential election in November.

The terms of the impending deal, details of which have been leaked to The Independent, are likely to have an explosive political effect in Iraq. Iraqi officials fear that the accord, under which US troops would occupy permanent bases, conduct military operations, arrest Iraqis and enjoy immunity from Iraqi law, will destabilise Iraq's position in the Middle East and lay the basis for unending conflict in their country.

But the accord also threatens to provoke a political crisis in the US. President Bush wants to push it through by the end of next month so he can declare a military victory and claim his 2003 invasion has been vindicated. But by perpetuating the US presence in Iraq, the long-term settlement would undercut pledges by the Democratic presidential nominee, Barack Obama, to withdraw US troops if he is elected president in November.

The timing of the agreement would also boost the Republican candidate, John McCain, who has claimed the United States is on the verge of victory in Iraq – a victory that he says Mr Obama would throw away by a premature military withdrawal.

America currently has 151,000 troops in Iraq and, even after projected withdrawals next month, troop levels will stand at more than 142,000 – 10 000 more than when the military "surge" began in January 2007. Under the terms of the new treaty, the Americans would retain the long-term use of more than 50 bases in Iraq. American negotiators are also demanding immunity from Iraqi law for US troops and contractors, and a free hand to carry out arrests and conduct military activities in Iraq without consulting the Baghdad government.

The precise nature of the American demands has been kept secret until now. The leaks are certain to generate an angry backlash in Iraq. "It is a terrible breach of our sovereignty," said one Iraqi politician, adding that if the security deal was signed it would delegitimise the government in Baghdad which will be seen as an American pawn.

The US has repeatedly denied it wants permanent bases in Iraq but one Iraqi source said: "This is just a tactical subterfuge." Washington also wants control of Iraqi airspace below 29,000ft and the right to pursue its "war on terror" in Iraq, giving it the authority to arrest anybody it wants and to launch military campaigns without consultation.

Mr Bush is determined to force the Iraqi government to sign the so-called "strategic alliance" without modifications, by the end of next month. But it is already being condemned by the Iranians and many Arabs as a continuing American attempt to dominate the region. Ali Akbar Hashemi Rafsanjani, the powerful and usually moderate Iranian leader, said yesterday that such a deal would create "a permanent occupation". He added: "The essence of this agreement is to turn the Iraqis into slaves of the Americans."

Iraq's Prime Minister, Nouri al-Maliki, is believed to be personally opposed to the terms of the new pact but feels his coalition government cannot stay in power without US backing.

The deal also risks exacerbating the proxy war being fought between Iran and the United States over who should be more influential in Iraq.

Although Iraqi ministers have said they will reject any agreement limiting Iraqi sovereignty, political observers in Baghdad suspect they will sign in the end and simply want to establish their credentials as defenders of Iraqi independence by a show of defiance now. The one Iraqi with the authority to stop deal is the majority Shia spiritual leader, Grand Ayatollah Ali al-Sistani. In 2003, he forced the US to agree to a referendum on the new Iraqi constitution and the election of a parliament. But he is said to believe that loss of US support would drastically weaken the Iraqi Shia, who won a majority in parliament in elections in 2005.

The US is adamantly against the new security agreement being put to a referendum in Iraq, suspecting that it would be voted down. The influential Shia cleric Muqtada al-Sadr has called on his followers to demonstrate every Friday against the impending agreement on the grounds that it compromises Iraqi independence.

The Iraqi government wants to delay the actual signing of the agreement but the office of Vice-President Dick Cheney has been trying to force it through. The US ambassador in Baghdad, Ryan Crocker, has spent weeks trying to secure the accord.

The signature of a security agreement, and a parallel deal providing a legal basis for keeping US troops in Iraq, is unlikely to be accepted by most Iraqis. But the Kurds, who make up a fifth of the population, will probably favour a continuing American presence, as will Sunni Arab political leaders who want US forces to dilute the power of the Shia. The Sunni Arab community, which has broadly supported a guerrilla war against US occupation, is likely to be split.

Iraq’s Prime Minister was staring into the abyss today after his operation to crush militia strongholds in Basra stalled, members of his own security forces defected and district after district of his own capital fell to Shia militia gunmen.

With the threat of a civil war looming in the south, Nouri al-Maliki’s police chief in Basra narrowly escaped assassination in the crucial port city, while in Baghdad, the spokesman for the Iraqi side of the US military surge was kidnapped by gunmen and his house burnt to the ground.

Saboteurs also blew up one of Iraq's two main oil pipelines from Basra, cutting at least a third of the exports from the city which provides 80 per cent of government revenue, a clear sign that the militias — who siphon significant sums off the oil smuggling trade — would not stop at mere insurrection.

In Baghdad, thick black smoke hung over the city centre tonight and gunfire echoed across the city.

The most secure area of the capital, Karrada, was placed under curfew amid fears the Mahdi Army of Hojetoleslam Moqtada al-Sadr could launch an assault on the residence of Abdelaziz al-Hakim, the head of a powerful rival Shia governing party.

While the Mahdi Army has not officially renounced its six-month ceasefire, which has been a key component in the recent security gains, on the ground its fighters were chasing police and soldiers from their positions across Baghdad.

Rockets from Sadr City slammed into the governmental Green Zone compound in the city centre, killing one person and wounding several more.

Mr al-Maliki has gambled everything on the success of Operation Saulat al-Fursan, or Charge of the Knights, to sweep illegal militias out of Basra.

It has targeted neighbourhoods where the Mahdi Army dominates, prompting intense fighting with mortars, rocket-grenades and machineguns in the narrow, fetid alleyways of Basra.

In Baghdad, the Mahdi Army took over neighbourhood after neighbourhood, some amid heavy fighting, others without firing a shot.

In New Baghdad, militiamen simply ordered the police to leave their checkpoints: the officers complied en masse and the guerrillas stepped out of the shadows to take over their checkpoints.

In Jihad, a mixed Sunni and Shia area of west Baghdad that had been one of the worst battlefields of Iraq’s dirty sectarian war in 2006, Mahdi units moved in and residents started moving out to avoid the lethal crossfire that erupted.

One witness saw Iraqi Shia policemen rip off their uniform shirts and run for shelter with local Sunni neighbourhood patrols, most of them made up of former insurgents wooed by the US military into fighting al-Qaeda.

In Baghdad, thousands of people marched in demonstrations in Shia areas demanding an end to the Basra operation, burning effigies of Mr al-Maliki, whom they branded a new dictator, and carrying coffins with his image on it.

From his field headquarters inside Basra city, the Prime Minister vowed to press on with his attack, which he said was not targeting the Mahdi Army in particular but all lawless gangs. "We have come to Basra at the invitation of the civilians to do our national duty and protect them from the gangs who have terrified them and stolen the national wealth," he said. "We promise to face the criminals and gunmen and we will never back off from our promise."

Supporters of Hojetoleslam al-Sadr, the rebellious cleric who formed the sprawling, 60,000-strong militia five years ago, have accused the Prime Minister of trying to wipe out the powerful Sadrists as a political force before provincial elections in October.

Residents of Basra complained that water and electricity had been turned off in the three main areas besieged by the Iraqi Army, which has an entire division deployed for the battle. They also said that they were running low on food an unable to evacuate their wounded. Estimates of the death toll in Basra reached as high as 200, with hundreds more wounded.

“The battle is not easy without coalition support,” lamented one Basra resident, who had worked as a translator for the British forces. “The police in Basra are useless and helping the Mahdi Army. The militia are hiding among the civilians. This country will never be safe, I want to leave for ever. I don’t know how to get out of this hell.”

One man was shot in the leg while trying to fix the rooftop water tank on his house but feared he would be taken for a militiaman if he tried to reach a hospital. Officials said that more than 200 militiamen had surrendered after the Government issued a three-day deadline to give themselves up.

While residents in Basra said that the army appeared to be making little headway against the militia bastions, a British Army spokesman based at nearby Basra airport said progress was being made.

“The Iraqi Army are rebalancing across the city, consolidating their positions, resupplying and preparing for future operations,” said Major Tom Holloway. “They made considerable progress, although not total progress by any stretch of the imagination.”

With fighting flaring across the Shia south, the police chief of Kut — where Mahdi fighters had seized large parts of the town, 110 miles southeast of Baghdad — said his men had killed 40 militiamen while losing four officers.

"The security forces launched an operation at around midnight to take back areas under the control of Shiite gunmen," Abdul Hanin al-Amara said.

While US and British military officials have been at pains to distance themselves from the push against the deadly militias, President Bush praised the high-risk strategy of tackling militias that a politically weak Mr al-Maliki had been forced to court in the past.

"Prime Minister Maliki's bold decision, and it was a bold decision, to go after the illegal groups in Basra shows his leadership and his commitment to enforce the law in an even-handed manner," Mr Bush said. "It also shows the progress the Iraqi security forces have made during the surge."

If the Iraqi forces fail to stamp out the powerful militias, however, and Iraq sinks into a new bout of in-fighting, Mr Bush’s troops and British forces may be forced to weigh in, sparking a new round of blood-letting ahead of US elections and scuttling British plans for an early withdrawal from Iraq.


Pentagon Quashes Release Of Report Which Everybody Knows About Anyway

Now another branch of our wonderful government has released a report that concludes, upon thorough review of over 600,000 documents, what most people have sort of figured out anyway: in the months before 9/11, Iraqi dictator Saddam Hussein was not gently humping al Qaeda mastermind Abu Musab al-Zarqawi on the banks of the Tigris. In fact, there was no connection of any sort between Iraq and al Qaeda, even though the President and his ghoulish cadre of advisors insisted there was. In a clever attempt to keep this shocking information from the American people, the government decided not to write a press release about it.

And then they went a step further. The Pentagon refused to post the report online, or email it. The spokesman for Joint Forces Command said they would send the report out, on CD, in the regular mail.

A second option, floated by the President, involves him hand-delivering a laptop computer to all interested parties.

But journalists were encouraged to take advantage of a third option, in which the report is delivered orally by a blind bard in about 2000 years and then everyone is immediately executed.

War costs estimated to exceed $3 trillion

Long-term factors pushfigure toward $7 trillion

WASHINGTON — When U.S. troops invaded Iraq in March 2003, the Bush administration predicted that the war would be self-financing, and rebuilding the nation would cost less than $2 billion.

Coming up on the five-year anniversary of the invasion, a new estimate from a Nobel laureate puts the cost of the wars in Iraq and Afghanistan at more than $3 trillion.

That estimate from Nobel Prize-winning economist Joseph Stiglitz also serves as the title of his new book, “The Three Trillion Dollar War,” which will hit store shelves Friday.

The book, co-authored with Harvard University professor Linda Bilmes, builds on previous research published in January 2006. The two argued then and now that the cost to America of the wars in Iraq and Afghanistan is wildly underestimated.

When other factors are added — such as interest on debt, future borrowing for war expenses, continued military presence in Iraq and lifetime health care and counseling for veterans — they think that the wars’ costs range from $5 trillion to $7 trillion.

“I think we really have learned that the long-term costs of taking care of the wounded and injured in this war and the long-term costs of rebuilding the military to its previous strength is going to far eclipse the cost of waging this war,” Bilmes said in an interview.

The book and its estimates are the subject of a hearing today by the Joint Economic Committee of Congress.

The White House criticized the estimates by Stiglitz, a former chief economist of the World Bank who is now a professor at Columbia University.

“People like Joe Stiglitz lack the courage to consider the cost of doing nothing and the cost of failure. One can’t even begin to put a price tag on the cost to this nation of the attacks of 9/11,” said White House spokesman Tony Fratto, conceding that the costs of the war on terrorism are high while questioning the premise of Stiglitz’s research.

“It is also an investment in the future safety and security of Americans and our vital national interests. $3 trillion? What price does Joe Stiglitz put on attacks on the homeland that have already been prevented? Or doesn’t his slide rule work that way?”

Rep. John Murtha, D-Pa., a decorated Marine Corps colonel and Vietnam veteran, welcomed the effort by Stiglitz and Bilmes to quantify the ways in which the wars will cost taxpayers. “It’s astounding that here we are about to mark the fifth anniversary of the invasion of Iraq, and this administration still refuses to acknowledge the long-term costs of the war in Iraq,” he said.

By any estimate, the Bush administration’s predictions in March 2003 of a self-financing war have proved drastically inaccurate. Stiglitz cites operational spending to date of $646 billion for the wars in Iraq and Afghanistan, and, working off estimates from the nonpartisan Congressional Budget Office, presumes that spending on these wars over the next decade probably will amount to $913 billion more.

Pentagon officials had no immediate comment on Stiglitz’s book or his estimates.

Stiglitz and Bilmes first estimated war costs of $1 trillion in January 2006. Their research proved controversial and sparked debate about the costs of replacing equipment used by the armed forces and National Guard units.

In the new book, they offer a figure of $404 billion for replacing equipment, planes and tanks and bringing military hardware back from Iraq and Afghanistan.

In an interview, Stiglitz said too much of the public debate had been over the wars’ operational costs while the real budget strains would show up only years from now.

“The peak expenditures are way out,” he said, noting that the peak expenditures for World War II veterans came in 1993.

The pair estimated that future medical, disability and Social Security costs for veterans of the wars in Iraq and Afghanistan range from a best-case $422 billion to what they call a more probable long-term expense of $717 billion.

It’s why their book calls for creating a Veterans Benefits Trust Fund to set aside money in a “lock box” to pay for future health care needs of Iraq and Afghanistan vets. Although veterans’ health care amounts to a future promise, they said, it isn’t an entitlement and instead is funded through discretionary spending.

In the future, funding for vets will compete with other government programs.

“We should not have an unfunded entitlement program like this,” Stiglitz said. “This is more like deferred compensation . . . We require corporations to put money away, but we don’t require the government to put money away, and we should be doing that . . . so when the focus turns away to some other problem, veterans aren’t [shortchanged].”




US warplanes pound Baghdad

US jet fighters have launched a massive air offensive on parts of Baghdad, hitting nearly 40 targets in the war-torn Iraqi capital.

US warplanes dropped 40,000 pounds of bombs on more than 40 targets on Baghdad's southern outskirts, the military said in a statement.

The US Air Force dispatched two B-1 bombers and four F-16 fighter jets, aiming at three large target areas in Arab Jabour.

The statement allegedly said that the strike had been on al Qaeda targets. It gave no details of casualties.

10. Myth: The US public no longer sees Iraq as a central issue in the 2008 presidential campaign.

In a recent ABC News/ Washington Post poll, Iraq and the economy were virtually tied among voters nationally, with nearly a quarter of voters in each case saying it was their number one issue. The economy had become more important to them than in previous months (in November only 14% said it was their most pressing concern), but Iraq still rivals it as an issue!

9. Myth: There have been steps toward religious and political reconciliation in Iraq in 2007. Fact: The government of Prime Minister Nuri al-Maliki has for the moment lost the support of the Sunni Arabs in parliament. The Sunnis in his cabinet have resigned. Even some Shiite parties have abandoned the government. Sunni Arabs, who are aware that under his government Sunnis have largely been ethnically cleansed from Baghdad, see al-Maliki as a sectarian politician uninterested in the welfare of Sunnis.

8. Myth: The US troop surge stopped the civil war that had been raging between Sunni Arabs and Shiites in the Iraqi capital of Baghdad.

Fact: The civil war in Baghdad escalated during the US troop escalation. Between January, 2007, and July, 2007, Baghdad went from 65% Shiite to 75% Shiite. UN polling among Iraqi refugees in Syria suggests that 78% are from Baghdad and that nearly a million refugees relocated to Syria from Iraq in 2007 alone. This data suggests that over 700,000 residents of Baghdad have fled this city of 6 million during the US 'surge,' or more than 10 percent of the capital's population. Among the primary effects of the 'surge' has been to turn Baghdad into an overwhelmingly Shiite city and to displace hundreds of thousands of Iraqis from the capital.

7. Myth: Iran was supplying explosively formed projectiles (a deadly form of roadside bomb) to Salafi Jihadi (radical Sunni) guerrilla groups in Iraq. Fact: Iran has not been proved to have sent weapons to any Iraqi guerrillas at all. It certainly would not send weapons to those who have a raging hostility toward Shiites. (Iran may have supplied war materiel to its client, the Supreme Islamic Council of Iraq (ISCI), which was then sold off from warehouses because of graft, going on the arms market and being bought by guerrillas and militiamen.

6. Myth: The US overthrow of the Baath regime and military occupation of Iraq has helped liberate Iraqi women. Fact: Iraqi women have suffered significant reversals of status, ability to circulate freely, and economic situation under the Bush administration.

5. Myth: Some progress has been made by the Iraqi government in meeting the "benchmarks" worked out with the Bush administration. Fact: in the words of Democratic Senator Carl Levin, "Those legislative benchmarks include approving a hydrocarbon law, approving a debaathification law, completing the work of a constitutional review committee, and holding provincial elections. Those commitments, made 1 1/2 years ago, which were to have been completed by January of 2007, have not yet been kept by the Iraqi political leaders despite the breathing space the surge has provided."

4. Myth: The Sunni Arab "Awakening Councils," who are on the US payroll, are reconciling with the Shiite government of PM Nuri al-Maliki even as they take on al-Qaeda remnants. Fact: In interviews with the Western press, Awakening Council tribesmen often speak of attacking the Shiites after they have polished off al-Qaeda. A major pollster working in Iraq observed,

' Most of the recent survey results he has seen about political reconciliation, Warshaw said, are "more about [Iraqis] reconciling with the United States within their own particular territory, like in Anbar. . . . But it doesn't say anything about how Sunni groups feel about Shiite groups in Baghdad." Warshaw added: "In Iraq, I just don't hear statements that come from any of the Sunni, Shiite or Kurdish groups that say 'We recognize that we need to share power with the others, that we can't truly dominate.' " ' '

The polling shows that "the Iraqi government has still made no significant progress toward its fundamental goal of national reconciliation."

3. Myth: The Iraqi north is relatively quiet and a site of economic growth. Fact: The subterranean battle among Kurds, Turkmen and Arabs for control of the oil-rich Kirkuk province makes the Iraqi north a political mine field. Kurdistan now also hosts the Kurdish Workers Party (PKK) guerrillas that sneak over the border and kill Turkish troops. The north is so unstable that the Iraqi north is now undergoing regular bombing raids from Turkey.

2. Myth: Iraq has been "calm" in fall of 2007 and the Iraqi public, despite some grumbling, is not eager for the US to depart. Fact: in the past 6 weeks, there have been an average of 600 attacks a month, or 20 a day, which has held steady since the beginning of November. About 600 civilians are being killed in direct political violence per month, but that number excludes deaths of soldiers and police. Across the board, Iraqis believe that their conflicts are mainly caused by the US military presence and they are eager for it to end.

1. Myth: The reduction in violence in Iraq is mostly because of the escalation in the number of US troops, or "surge."

Fact: Although violence has been reduced in Iraq, much of the reduction did not take place because of US troop activity. Guerrilla attacks in al-Anbar Province were reduced from 400 a week to 100 a week between July, 2006 and July, 2007. But there was no significant US troop escalation in al-Anbar. Likewise, attacks on British troops in Basra have declined precipitously since they were moved out to the airport away from population centers. But this change had nothing to do with US troops.

Bush's World War III 'Solution'

Don't worry, the White House is telling us. The world's most powerful leader was simply making a rhetorical point. At a White House press conference last week, just in case you haven't heard, President Bush informed the American people that he had told world leaders "if you're interested in avoiding World War III, it seems like you ought to be interested in preventing [Iran] from having the knowledge necessary to make a nuclear weapon." World War III. That is certainly some rhetorical point, especially coming from the man singularly most capable of making such an event reality.

Pundits have raised their eyebrows and comics are busy writing jokes, but the president's reference to Armageddon, no matter how cavalierly uttered and subsequently brushed away, suggests an alarming context. Some might note that the comment was simply an offhand response to a reporter's question, the kind of free-thinking scenario that baffles Bush so. In a way, this makes what the president said even more disturbing, since we now have an insight into the vision, and related terminology, which hovers just below the horizon in the brain of George W. Bush.

When I was a weapons inspector with the United Nations, there was a jostling that took place at the end of each day, when decisions needed to be made and authorization documents needed to be signed. In an environment of competing agendas, each of us who championed a position sought to be the "last man in," namely the person who got to imprint the executive chairman (our decision maker) with the final point of view for the day. Failure to do so could find an inspection or point of investigation sidetracked for days or weeks after the executive chairman became distracted by a competing vision. I understand the concept of "imprinting," and have seen it in action. What is clear from the president's remarks is that, far from an innocent rhetorical fumble, his words, and the context in which he employed them, are a clear indication of the imprinting which is taking place behind the scenes at the White House. If the president mentions World War III in the context of Iran's nuclear program, one can be certain that this is the very sort of discussion that is taking place in the Oval Office.

A critical question, therefore, is who was the last person to "imprint" the president prior to his public allusion to World War III? During his press conference, Bush noted that he awaited the opportunity to confer with his defense secretary, Robert Gates, and Secretary of State Condoleezza Rice following their recent meeting with Russian President Vladimir Putin. So clearly the president hadn't been imprinted recently by either of the principle players in the formulation of defense and foreign policy. The suspects, then, are quickly whittled down to three: National Security Adviser Stephen Hadley, Vice President Dick Cheney, and God.

Hadley is a long-established neoconservative thinker who has for the most part operated "in the shadows" when it comes to the formulation of Iran policy in the Bush administration. In 2001, following the 9/11 terrorist attacks on the United States, Hadley (then the deputy national security adviser) instituted what has been referred to as the "Hadley Rules," a corollary of which is that no move will be made which alters the ideological positioning of Iran as a mortal enemy of the United States. These "rules" shut down every effort undertaken by Iran to seek a moderation of relations between it and the United States, and prohibited American policymakers from responding favorably to Iranian offers to assist with the fight against al-Qaida; they also blocked the grand offer of May 2003 in which Iran outlined a dramatic diplomatic initiative, including a normalization of relations with Israel. The Hadley Rules are at play today, in an even more nefarious manner, with the National Security Council becoming involved in the muzzling of former Bush administration officials who are speaking out on the issue of Iran. Hadley is blocking Flynt Leverett, formerly of the National Security Council, from publishing an Op-Ed piece critical of the Bush administration on the grounds that any insight into the machinations of policymaking (or lack thereof) somehow strengthens Iran's hand. Leverett's article would simply underscore the fact that the Bush administration has spurned every opportunity to improve relations with Iran while deliberately exaggerating the threat to U.S. interests posed by the Iranian theocracy.

The silencing of informed critics is in keeping with Hadley's deliberate policy obfuscation. There is still no official policy in place within the administration concerning Iran. While a more sober-minded national security bureaucracy works to marginalize the hawkish posturing of the neocons, the administration has decided that the best policy is in fact no policy, which is a policy decision in its own right. Hadley has forgone the normal procedures of governance, in which decisions impacting the nation are written down, using official channels, and made subject to review and oversight by those legally and constitutionally mandated and obligated to do so. A policy of no policy results in secret policy, which means, according to Hadley himself, the Bush administration simply does whatever it wants to, regardless. In the case of Iran, this means pushing for regime change in Tehran at any cost, even if it means World War III.

But Hadley is simply a facilitator, bureaucratic "grease" to ease policy formulated elsewhere down the gullet of a national security infrastructure increasingly kept in the dark about the true intent of the Bush administration when it comes to Iran. With the Department of State and the Pentagon now considered unfriendly ground by the remaining hard-core neoconservative thinkers still in power, policy formulation is more and more concentrated in the person of Vice President Cheney and the constitutionally nebulous "Office of the Vice President."

Cheney and his cohorts have constructed a never-never land of oversight deniability, claiming immunity from both executive and legislative checks and balances. With an unchallenged ability to classify anything and everything as secret, and then claim that there is no authority inherent in government to oversee that which has been thus classified, the Office of the Vice President has transformed itself into a free republic's worst nightmare, assuming Caesar-like dictatorial authority over almost every aspect of American national security policy at home and abroad. From torture to illegal wiretapping, to arms control (or lack of it) to Iran, Dick Cheney is the undisputed center of policy power in America today. While there are some who will claim that in this time of post-9/11 crisis such a process of bureaucratic streamlining is essential for the common good, the reality is far different.

It is said that absolute power corrupts absolutely, and this has never been truer than in the case of Cheney. What Cheney is doing behind his shield of secrecy can be simply defined: planning and implementing a preemptive war of aggression. During the Nuremberg tribunal in the aftermath of World War II, the chief American prosecutor, Supreme Court Justice Robert H. Jackson, stated, "To initiate a war of aggression, therefore, is not only an international crime; it is the supreme international crime differing only from other war crimes in that it contains within itself the accumulated evil of the whole." Today, we have a vice president who articulates publicly about global conflict, and who speaks in not-so-veiled language about a looming Armageddon. If there is such a future for America and the world, let one thing be certain; World War III, as postulated by Dick Cheney, would be an elective war, and not a conflict of tragic necessity. This makes the crime even greater.

Sadly, Judge Jackson's words are but an empty shell. The global community lacks a legally binding definition of what constitutes a war of aggression, or even an act of aggression. But that isn't the point. America should never find itself in a position where it is being judged by the global community regarding the legality of its actions. Judge Jackson established a precedent of jurisprudence concerning aggression based upon American principles and values, something the international community endorsed. The fact that current American indifference to the rule of law prevents the international community from certifying a definition of criminality when it comes to aggression, whether it be parsed as "war" or simply an "act," does not change the fact that the Bush administration, in the person of Dick Cheney, is actively engaged in the committing of the "supreme [war] crime," which makes Cheney the supreme war criminal. If the world is not empowered to judge him as such, then let the mantle of judgment fall to the American people. Through their elected representatives in Congress, they should not only bring this reign of unrestrained abuse of power to an end, but ensure that such abuse never again is attempted by an American official by holding to account, to the full extent of the law, those who have trampled on the Constitution of the United States and the ideals and principles it enshrines.

But what use is the rule of law, even if fairly and properly implemented, if in the end he who is entrusted with executive power takes his instructions from an even higher authority? President Bush's relationship with "God" (or that which he refers to as God) is a matter of public record. The president himself has stated that "God speaks through me" (he acknowledged this before a group of Amish in Pennsylvania in the summer of 2004). Exactly how God speaks through him, and what precisely God says, is not a matter of speculation. According to Palestinian President Mahmoud Abbas, President Bush told him and others that "God told me to strike at al-Qaida and I struck them, and then he instructed me to strike at Saddam, which I did." As such, at least in the president's mind, God has ordered Bush to transform himself into a modern incarnation of St. Michael, smiting all that is evil before him. "We are in a conflict between good and evil. And America will call evil by its name," the president told West Point cadets in a speech in 2002.

The matter of how and when an individual chooses to practice his faith, or lack thereof, is a deeply personal matter, one which should be kept from public discourse. For a president to so openly impose his personal religious beliefs, as Bush has done, on American policy formulation and implementation represents a fundamental departure from not only constitutional intent concerning the separation of church and state but also constitutional mandate concerning the imposition of checks and balances required by the American system of governance. The increasing embrace by this president of the notion of a unitary executive takes on an even more sinister aspect when one realizes that not only does the Bush administration seek to nullify the will of the people through the shackling of the people's representatives in Congress, but that the president has forgone even the appearance of constitutional constraint by evoking the word of his personal deity, as expressed through his person, as the highest form of consultation on a matter as serious as war. As such, the president has made his faith, and how he practices it, a subject not only of public curiosity but of national survival.

That George W. Bush is a born-again Christian is not a national secret. Neither is the fact that his brand of Christianity, evangelicalism, embraces the notion of the "end of days," the coming of the Apocalypse as foretold (so they say) in the Book of Revelations and elsewhere in the Bible. President Bush's frequent reference to "the evil one" suggests that he not only believes in the Antichrist but actively proselytizes on the Antichrist's physical presence on Earth at this time. If one takes in the writing and speeches of those in the evangelical community today concerning the "rapture," the numerous references to the current situation in the Middle East, especially on the events unfolding around Iran and its nuclear program, make it very clear that, at least in the minds of these evangelicals, there is a clear link between the "end of days" prophesy and U.S.-Iran policy. That James Dobson, one of the most powerful and influential evangelical voices in America today, would be invited to the White House with like-minded clergy to discuss President Bush's Iran policy is absurd unless one makes the link between Bush's personal faith, the extreme religious beliefs of Dobson and the potential of Armageddon-like conflict (World War III). At this point, the absurd becomes unthinkable, except it is all too real.

Thomas Jefferson, one of our nation's greatest founders, made the separation of church and state an underlying principle upon which the United States was built. This separation was all-inclusive, meaning that not only should government stay out of religion, but likewise religion should be excluded from government. "I never submitted the whole system of my opinions to the creed of any party of men whatever in religion, in philosophy, in politics, or in anything else where I was capable of thinking for myself," Jefferson wrote in a letter to Francis Hopkinson in 1789. "Such an addiction is the last degradation of a free and moral agent." If only President Bush would abide by such wisdom, avoiding the addictive narcotic of religious fervor when carrying out the people's business. Instead, he chooses as his drug one which threatens to destroy us all in a conflagration derived not from celestial intervention but individual ignorance and arrogance. Again Jefferson, in a letter written in 1825: "It is between fifty and sixty years since I read it [the Apocalypse], and I then considered it merely the ravings of a maniac, no more worthy nor capable of explanation than the incoherences of our own nightly dreams."

Nightmares, more aptly, unless something can be done to change the direction Bush and Dobson are taking us. The problem is that far too many Americans openly espouse not only the faith of George W. Bush but also the underlying philosophy which permits this faith to be intertwined with the governance of the land. "God bless America" has become a rallying cry for this crowd, and those too ignorant and/or afraid to speak out in opposition. If this statement has merit, what does it say for the 6.8 billion others in the world today who are not Americans? That God condemns them? The American embrace of divine destiny is not unique in history (one only has to recall that the belt buckles of the German army during World War II read "God is with us"). But for a nation born of the age of reason to collectively fall victim to the most base of fear-induced theology is a clear indication that America currently fails to live up to its founding principles. Rather than turning to Dobson and his ilk for guidance in these troubled times, Americans would be well served to reflect on President Abraham Lincoln's second inaugural address, delivered in the middle of a horrific civil war which makes all of the conflict America finds itself in today pale in comparison:

"Both [North and South] read the same Bible and pray to the same God, and each invokes His aid against the other.... The prayers of both could not be answered. That of neither has been answered fully. The Almighty has His own purposes.... [T]hat He gives to both North and South this terrible war as the woe due to those by whom the offense came, shall we discern therein any departure from those divine attributes which the believers in a living God always ascribe to Him?"

God is not on our side, or the side of any single nation or people. To believe such is the ultimate expression of national hubris. To invoke such, if one is a true believer, is to embrace sacrilege and heresy. This, of course, is an individual right, granted as an extension of religious freedom. But it is not a collective right, nor is it a right born of governance, especially in a land protected by the separation of church and state.

The issue of Iran is a national problem which requires a collective debate, discussion and dialogue inclusive of all the facts, and stripped of all ideology and theocracy which would seek to deny reasoned thought conducted within a framework of accepted laws and ideals. It is grossly irresponsible of an American president to invoke the imagery of World War III without first sharing with the American people the framework of thought that produced such a comparison. Such openness will not be forthcoming from this administration or president. Not in the form of Stephen Hadley's policy of no policy, designed with intent to avoid and subvert both bureaucratic and legislative process and oversight, or Dick Cheney's secret government within a government, operating above and beyond the law and in a manner which violates both legal and moral norms and values, and certainly not in the president's own private conversations with "God," either directly or through the medium of lunatic evangelicals who embrace the termination of all we stand for, and especially the future of our next generation, in a fiery holocaust born from the fraudulent writings of centuries past.

The processes which compelled George W. Bush to speak of a World War III are intentionally not transparent to the American people. The president has much to explain, and it would be incumbent upon every venue of civic and public pressure to demand that such an explanation be forthcoming in the near future. The stakes regarding Iran have always been high, but never more so than when a nation's leader invokes the end of days as a solution.

Military aspect of immigrant bill eyed

Foes say some grads may be forced to join

Legislation that could grant legal status to hundreds of thousands of undocumented high school graduates is creating a schism among Latino educators and others who have typically favored legalization efforts.

At issue is a component of the Development, Relief and Education for Alien Minors Act, or DREAM Act, a bill that could be voted on in the Senate by next week as an amendment to a Department of Defense authorization bill.

The proposed legislation, a version of which was first introduced in 2001, would make high school graduates who arrived in the United States illegally at 15 or younger and who have lived here at least five years, eligible for conditional legal status provided they attend two years of college or serve two years in the military. After six years, those who meet the conditions could obtain legal permanent resident status.

It is the military service component that has landed some Latino supporters of legalization measures on the same side of the proposal as the immigration restriction lobby, which decries the DREAM Act as amnesty.

Those uncomfortable with the military component see the measure as a devil's bargain: On one hand, it offers a shot at higher education and success to young people who might otherwise have to spend their lives in the shadows. On the other, they fear that those who can't afford college, or don't see it as a viable choice, might feel compelled to join the military not because they want to, but because they fear eventual deportation.

“This is very tricky, because undocumented students are desperate for some kind of legalization,” said Jorge Mariscal, director of the University of California San Diego's Chicano Studies program and a longtime critic of military recruiting within minority communities. “I'm completely conflicted.”

The DREAM Act has the support of mainstream Latino organizations, such as the National Council of La Raza and the League of United Latin American Citizens, who praise it as a life-changing opportunity for students.

It has also been promoted by other supporters, including sponsor Sen. Dick Durbin, D-Ill., as a way to boost military recruiting at a time when the protracted Iraq war demands it. In a telephone news conference Monday, U.S. Army Reserve Lt. Col. Margaret Stock called the measure “germane to the Department of Defense.”

“This is a way to maintain an all-volunteer force, and keep that force supplied with very high-quality people,” said Stock, an associate professor at the U.S. Military Academy at West Point.

The U.S. Army fell short of its recruitment goals in June and July, said Paul Boyce, an Army spokesman, although he said goals were met in August. In fiscal year 2006, 12.6 percent of active Army recruits nationwide were Latino.

In San Diego, the nation's second-largest hub of military operations, there has been opposition to the bill from those who say that children of low-income immigrants already have a propensity to enlist in the military in exchange for the promise of a college education their parents can't afford, or because they simply can't envision college as an option.

College is an enlistment carrot for young U.S. citizens and legal residents, said Rick Jahnkow, coordinator of the Encinitas-based Project on Youth and Non-Military Opportunities, which promotes alternatives to enlistment for those seeking education and job training. Legal immigrants were given added incentive to enlist in 2002, when President Bush signed an executive order expediting U.S. citizenship for foreign-born active-duty military personnel.

Supporters of the DREAM Act say high school graduates who stand to benefit have a choice between college or the military. But with the only other option to remain undocumented, Jahnkow said, some who can't see going the college route might be motivated to enlist not so much by what they might gain, but by fear of what they stand to lose.

“You might be deported if you don't make a move to take advantage of this,” he said. “It's more of an incentive than the general economic one. It's the threat of possibly being deported, on top of that, which is going to result in a much higher enlistment rate . . . I think some will want to join the military, but I think more will essentially be coerced into it.”

In San Diego and Los Angeles, a group of politically involved teachers known as the Association of Raza Educators has come out against the proposal, citing the same concerns.

“There is the carrot, and there is also the stick behind it,” said Miguel Zavala, a part-time teaching instructor at Cal State Los Angeles. “They have their hands tied behind their backs. It's not like they can just choose.”

The military has served as a stick to other generations, but in much different contexts. During the Vietnam War, for example, the draft persuaded many young men to remain in college and retain a draft deferment.

Judges have also tried to coerce enlistment as an alternative to jail: Last year, a New York judge gave this choice to a 20-year-old man whom the Army ultimately rejected, citing regulations that prevent people with pending charges from enlisting.

In spite of its military component, Latino educators who support the DREAM Act believe that the pros of the measure far outweigh the cons.

“The DREAM Act would open so many doors for so many deserving students who do not have proper documentation,” said Carmen Garcia, principal of Roosevelt Middle School near Balboa Park. “It is a seed of hope that so many students have been waiting for, that so many parents have been waiting for.”

The military component is “an added nuance,” Garcia said, “but it opens the door to other possibilities.”

The Migration Policy Institute has estimated that 360,000 undocumented high school graduates would immediately be eligible for conditional legal status under the measure, and that about 50,000 of them are enrolled in U.S. colleges and universities.

Under the DREAM Act, college-bound students who receive conditional legal status could take advantage of federal student loans – though not grants – now unavailable to illegal immigrants. However, a provision that would have granted them in-state tuition fees was removed from the proposal.

Hagel: White House Originally Wanted 2002 Iraq War Resolution to Cover Entire Middle East

The Bush administration has taken a series of steps in recent weeks that appear to be setting the stage for a military confrontation with Iran. Congressional leaders have been raising red flags. “I’d like to be clear,” Senate Majority Leader Harry Reid (D-NV) said last week. “The president does not have the authority to launch military action in Iran without first seeking congressional authorization.” Recent comments made by Sen. Chuck Hagel (R-NE) explain why Congress’s resistance is so vital.

In an interview in GQ Magazine, Hagel reveals that the Bush administration tried to get Congress to approve military action anywhere in the Middle East — not just in Iraq — in the fall of 2002. At the time, Hagel says, the Bush administration presented Congress with a resolution that would have authorized the use of force anywhere in the region:

HAGEL: [F]inally, begrudgingly, [the White House] sent over a resolution for Congress to approve. Well, it was astounding. It said they could go anywhere in the region.

GQ: It wasn’t specific to Iraq?

HAGEL: Oh no. It said the whole region! They could go into Greece or anywhere. Is central Asia in the region? I suppose! Sure as hell it was clear they meant the whole Middle East. It was anything. It was literally anything. No boundaries. No restrictions.

GQ: They expected Congress to let them start a war anywhere in the Middle East?

HAGEL: Yes. Yes. Wide open. We had to rewrite it. Joe Biden, Dick Lugar, and I stripped the language that the White House had set up and put our language in it.

Asked about his vote in support of the final Iraq war resolution, Hagel told GQ, “Do I regret that vote? Yes, I do regret that vote.”

Bomb-laden 'Reaper' drones bound for Iraq
BALAD AIR BASE, Iraq (AP) — The airplane is the size of a jet fighter, powered by a turboprop engine, able to fly at 300 mph and reach 50,000 feet. It is outfitted with infrared, laser and radar targeting, and with a ton and a half of guided bombs and missiles.

The Reaper is loaded, but there is no one on board. Its pilot, as it bombs targets in Iraq, will sit at a video console 7,000 miles away in Nevada.

The arrival of these outsized U.S. "hunter-killer" drones, in aviation history's first robot attack squadron, will be a watershed moment even in an Iraq that has seen too many innovative ways to hunt and kill.

That moment, one the Air Force will likely low-key, is expected "soon," says the regional U.S. air commander. How soon? "We're still working that," Lt. Gen. Gary North said in an interview.

The Reaper's first combat deployment is expected in Afghanistan, and senior Air Force officers estimate it will land in Iraq sometime between this fall and next spring. They look forward to it.

"With more Reapers, I could send manned airplanes home," North said.

The Associated Press has learned that the Air Force is building a 400,000-square-foot expansion of the concrete ramp area now used for Predator drones here at Balad, the biggest U.S. air base in Iraq, 50 miles north of Baghdad. That new staging area could be turned over to Reapers.

It is another sign that the Air Force is planning for an extended stay in Iraq, supporting Iraqi government forces in any continuing conflict, even if U.S. ground troops are drawn down in the coming years.

The estimated two dozen or more unmanned MQ-1 Predators now doing surveillance over Iraq, as the 46th Expeditionary Reconnaissance Squadron, have become mainstays of the U.S. war effort, offering round-the-clock airborne "eyes" watching over road convoys, tracking nighttime insurgent movements via infrared sensors, and occasionally unleashing one of their two Hellfire missiles on a target.

From about 36,000 flying hours in 2005, the Predators are expected to log 66,000 hours this year over Iraq and Afghanistan.

The MQ-9 Reaper, when compared with the 1995-vintage Predator, represents a major evolution of the unmanned aerial vehicle, or UAV.

At five tons gross weight, the Reaper is four times heavier than the Predator. Its size — 36 feet long, with a 66-foot wingspan — is comparable to the profile of the Air Force's workhorse A-10 attack plane. It can fly twice as fast and twice as high as the Predator. Most significantly, it carries many more weapons.

While the Predator is armed with two Hellfire missiles, the Reaper can carry 14 of the air-to-ground weapons — or four Hellfires and two 500-pound bombs.

"It's not a recon squadron," Col. Joe Guasella, operations chief for the Central Command's air component, said of the Reapers. "It's an attack squadron, with a lot more kinetic ability."

"Kinetic" — Pentagon argot for destructive power — is what the Air Force had in mind when it christened its newest robot plane with a name associated with death.

"The name Reaper captures the lethal nature of this new weapon system," Gen. T. Michael Moseley, Air Force chief of staff, said in announcing the name last September.

General Atomics of San Diego has built at least nine of the MQ-9s thus far, at a cost of $69 million per set of four aircraft, with ground equipment.

The Air Force's 432nd Wing, a UAV unit formally established on May 1, is to eventually fly 60 Reapers and 160 Predators. The numbers to be assigned to Iraq and Afghanistan will be classified.

The Reaper is expected to be flown as the Predator is — by a two-member team of pilot and sensor operator who work at computer control stations and video screens that display what the UAV "sees." Teams at Balad, housed in a hangar beside the runways, perform the takeoffs and landings, and similar teams at Nevada's Creech Air Force Base, linked to the aircraft via satellite, take over for the long hours of overflying the Iraqi landscape.

American ground troops, equipped with laptops that can download real-time video from UAVs overhead, "want more and more of it," said Maj. Chris Snodgrass, the Predator squadron commander here.

The Reaper's speed will help. "Our problem is speed," Snodgrass said of the 140-mph Predator. "If there are troops in contact, we may not get there fast enough. The Reaper will be faster and fly farther."

The new robot plane is expected to be able to stay aloft for 14 hours fully armed, watching an area and waiting for targets to emerge.

"It's going to bring us flexibility, range, speed and persistence," said regional commander North, "such that I will be able to work lots of areas for a long, long time."

The British also are impressed with the Reaper, and are buying three for deployment in Afghanistan later this year. The Royal Air Force version will stick to the "recon" mission, however — no weapons on board.

Is the United States Killing 10,000 Iraqis Every Month? Or Is It More?

A state-of-the-art research study published in October 12, 2006 issue of The Lancet (the most prestigious British medical journal) concluded that -- as of a year ago -- 600,000 Iraqis had died violently due to the war in Iraq. That is, the Iraqi death rate for the first 39 months of the war was just about 15,000 per month.

That wasn't the worst of it, because the death rate was increasing precipitously, and during the first half of 2006 the monthly rate was approximately 30,000 per month, a rate that no doubt has increased further during the ferocious fighting associated with the current American surge.

The U.S. and British governments quickly dismissed these results as "methodologically flawed," even though the researchers used standard procedures for measuring mortality in war and disaster zones. (They visited a random set of homes and asked the residents if anyone in their household had died in the last few years, recording the details, and inspecting death certificates in the vast majority of cases.) The two belligerent governments offered no concrete reasons for rejecting the study's findings, and they ignored the fact that they had sponsored identical studies (conducted by some of the same researchers) in other disaster areas, including Darfur and Kosovo. The reasons for this rejection were, however, clear enough: the results were simply too devastating for the culpable governments to acknowledge. (Secretly the British government later admitted that it was "a tried and tested way to measuring mortality in conflict zones"; but it has never publicly admitted its validity).

Reputable researchers have accepted the Lancet study's results as valid with virtually no dissent. Juan Cole, the most visible American Middle East scholar, summarized it in a particularly vivid comment: "the US misadventure in Iraq is responsible [in a little over three years] for setting off the killing of twice as many civilians as Saddam managed to polish off in 25 years."

Despite the scholarly consensus, the governments' denials have been quite effective from a public education point of view, and the few news items that mention the Lancet study bracket it with official rebuttals. One BBC report, for example, mentioned the figure in an article headlined "Huge Rise in Iraqi Death Tolls," and quoted at length from President Bush's public rebuttal, in which he said that the methodology was "pretty well discredited," adding that "six-hundred thousand or whatever they guessed at is just ... it's not credible." As a consequence of this sort of coverage, most Americans probably believe that Bush's December 2005 figure of 30,000 Iraqi civilian deaths (less than 10% of the actual total) is the best estimate of Iraqi deaths up to that time.

Counting how many Iraqis the occupation has killed

These shocking statistics are made all the more horrific when we realize that among the 600,000 or so victims of Iraqi war violence, the largest portion have been killed by the American military, not by carbombings or death squads, or violent criminals -- or even all these groups combined.

The Lancet interviewers asked their Iraqi respondents how their loved ones died and who was responsible. The families were very good at the cause of death, telling the reporters that over half (56%) were due to gunshots, with an eighth due each to car bombs (13%), air strikes (13%) and other ordinance (14%). Only 4% were due to unknown causes.

The families were not as good at identifying who was responsible. Although they knew, for example, that air strike victims were killed by the occupation, and that carbomb victims were killed by insurgents, the gunshot and ordinance fatalities often occurred in firefights or in circumstances with no witnesses. Many times, therefore, they could not tell for sure who was responsible. Only were certain, and the interviewers did not record the responsible party if "households had any uncertainly" as to who fired the death shot.

The results are nevertheless staggering for those of us who read the American press: for the deaths that the victims families knew for sure who the perpetrator was, U.S. forces (or their "Coalition of the Willing" allies) were responsible for 56%. That is, we can be very confident that the Coalition had killed at least 180,000 Iraqis by the middle of 2006. Moreover, we have every reason to believe that the U.S. is responsible for its pro rata share (or more) of the unattributed deaths. That means that the U.S. and its allies may well have killed upwards of 330,000 Iraqis by the middle of 2006.

The remainder can be attributed to the insurgents, criminals, and to Iraqi forces. And let's be very clear here: car bombs, the one source that was most easy for victims' families to identify, was responsible for 13% of the deaths, about 80,000 people, or about 2,000 per month. This is horrendous, but it is far less than half of the confirmed American total, and less than a quarter of the probable American total.

Even if we work with the lower, confirmed, figured of 180,000 Iraqi deaths caused by the occupation firepower, which yields an average of just over 5,000 Iraqis killed every month by U.S. forces and our allies since the beginning of the war. And we have to remember that the rate of fatalities was twice as high in 2006 as the overall average, meaning that the American average in 2006 was well over 10,000 per month, or something over 300 Iraqis every day, including Sundays. With the surge that began in 2007, the current figure is likely even higher.

Why don't we know about this?

These figures sound impossible to most Americans. Certainly 300 Iraqis killed by Americans each day would be headline news, over and over again. And yet, the electronic and print media simply do not tell us that the U.S. is killing all these people. We hear plenty about car bombers and death squads, but little about Americans killing Iraqis, except the occasional terrorist, and the even more occasional atrocity story.

How, then, is the US accomplishing this carnage, and why is it not newsworthy? The answer lies in another amazing statistic: this one released by the U.S. military and reported by the highly respectable Brookings Institution: for the past four years, the American military sends out something over 1,000 patrols each day into hostile neighborhoods, looking to capture or kill insurgents and terrorists. (Since February, the number has increased to nearly 5,000 patrols a day, if we include the Iraqi troops participating in the American surge.)

These thousands of patrols regularly turn into thousands of Iraqi deaths because these patrols are not the "walk in the sun" that they appear to be in our mind's eye. Actually, as independent journalist Nir Rosen described vividly and agonizingly in his indispensable book, In the Belly of the Green Bird, they involve a kind of energetic brutality that is only occasionally reported by an embedded American mainstream journalist.

This brutality is all very logical, once we understand the purpose and process of these patrols. American soldiers and marines are sent into hostile communities where virtually the entire population is supports the insurgency. They often have a list of suspects' addresses; and their job is to interrorgate or arrest or kill the suspect; and search the house for incriminating evidence, particularly arms and ammunition, but also literature, video equipment, and other items that the insurgency depends upon for its political and military activities. When they don't have lists of suspects, they conduct "house-to-house" searches, looking for suspicious behavior, individuals or evidence.

In this context, any fighting age man is not just a suspect, but a potentially lethal adversary. Our soldiers are told not to take any chances: in many instances, for example, knocking on doors could invite gunshots through the doors. Their instructions are therefore to use the element of surprise whenever the situation appears to be dangerous -- to break down doors, shoot at anything suspicious, and throw grenades into rooms or homes where there is any chance of resistance. If they encounter tangible resistance, they can call in artillery and/or air power rather than try to invade a building.

Here is how two Iraqi civilians described these patrols to Asia Times reporter Pepe Escobar:

"Hussein and Hasan confirm that the Americans usually 'come at night, sometimes by day, always protected by helicopters.' They "sometimes bomb houses, sometimes arrest people, sometimes throw missiles'"

If they encounter no resistance, these patrols can track down 30 or so suspects, or inspect several dozen homes, in a days work. That is, our 1,000 or so patrols can invade 30,000 homes in a single day. But if an IED explodes under their Humvee or a sniper shoots at them from nearby, then their job is transformed into finding, capturing, or killing the perpetrator of the attack. Iraqi insurgents often set off IEDs and invite these firefights, in order to stall the patrols prevent the soldiers from forcibly entering 30 or so homes, violently accosting their residents, and perhaps beating, arresting, or simply humiliating the residents.

The battles triggered by IEDs and sniper attacks almost always involve the buildings surrounding the incident, since that is where the insurgents take cover to avoid the American counter-attack. Americans, therefore, regular shoot into these buildings where the perpetrators are suspected of hiding, with all the attendant dangers of killing other people. The rules of engagement for American soldiers include efforts to avoid killing civilians, and there are many accounts of restraint because civilians are visibly in the line of fire. But if they are in hot pursuit of a perpetrator, their rules of engagement make it clear that capturing or killing the insurgent takes precedent over civilian safety.

This sounds pretty tame, and not capable of generating the statistics that the Lancet study documented. But the sheer quantity of American patrols -- 1,000 each day -- and the sheer quantity of the confrontations inside people's homes, the responses to sniper and IED attacks, and the ensuring firefights add up to mass slaughter.

The cumulative brutality of these thousands of patrols can be culled from the recent inquest into the suspected war crimes committed in the city of Haditha back in November 19, 2005. The investigation seeks to ascertain whether American marines deliberately murdered 24 civilians including executing with point blank head shots nineteen unarmed women, children and older men in a single room, apparently in retribution for the death of one of their comrades earlier in the day. These horrific charges have made the incident newsworthy and propelled the investigation.

But it is the defense's version of the story that makes the Haditha useful in understanding the translation of American patrols into hundreds of thousands of Iraqi deaths. First Lt. William T. Kallop, the highest ranking officer in Haditha that day, told the military hearing that he had ordered a patrol "to 'clear' an Iraqi home in Haditha after a roadside bomb had killed a Marine" earlier in the day. Later, after the firefight that this action generated, he went to inspect the home and was shocked to discover that only civilians had been killed:

"He inspected one of the homes with a Marine corporal, Hector Salinas, and found women, children and older men who had been killed when marines threw a grenade into the room. "'What the hell happened, why aren't there any insurgents here?' Lieutenant Kallop testified that he asked aloud. 'I looked at Corporal Salinas, and he looked just as shocked as I did.'

It is important to keep in mind that Lt. Kallop would not have been shocked if there had been one or more insurgents among the dead. What made the situation problematic was that all the fatalities were clearly civilians, and it led to the possibility that they had not been in hot pursuit of an enemy combatant.

Later, however, Lt. Kallop decided that even this situation involved no misbehavior on the part of his troops, after questioning Staff Sgt. Frank D. Wuterich, who had led the patrol and commanded the military action:

"Sergeant Wuterich had told him that they had killed people [in that house] after approaching a door to it and hearing the distinct metallic sound of an AK-47 being prepared to fire. "'I thought that was within the rules of engagement because the squad leader thought that he was about to kick in the door and walk into a machine gun,' Lieutenant Kallop said." According to Kallop, the soldiers were thus following the rules of engagement because if the squad leader "thought" that he was going to be attacked (based on recognizing a noise through a closed door), he was authorized and justified to use the full lethal force of the patrol (in this case a hand grenade), enough to kill all the people huddled within the apartment.

The critical distinction has to do with intentionality. First Lieutenant Max D. Frank, sent to investigate the incident somewhat later, explained this logic: "It was unfortunate what happened, sir," Lieutenant Frank told the Marine prosecutor, Lt. Col. Sean Sullivan, "but I didn't have any reason to believe that what they had done was on purpose."

Translated, this means that as long as the soldiers sincerely believed that their attack might capture or kill an armed insurgent who could attack them, the rules of engagement justified their action and they were therefore not culpable of any crime.

Note here that other alternatives were not considered. The soldiers could have decided that there was a good chance of hurting civilians in this situation, and therefore retreated without pursuing the suspected insurgent. This would have allowed him to get away, but it would have protected the residents of the house. This option was not considered, even though many of us might feel that letting one or two or three insurgents escape (in a town filled with insurgents) might be acceptable instead of risking (and ultimately ending) the lives of 19 civilians.

Later in the hearing, Major General Richard Huck, the commanding officer in charge of the Marines in Haditha, underscored these rules of engagement in more general terms, -- and also ignored the unthinkable option of letting the insurgents get away -- when he explained why he had not ordered an investigation of the deaths:

"They had occurred during a combat operation and it was not uncommon for civilians to die in such circumstances. 'In my mind's eye, I saw insurgent fire, I saw Kilo Company fire,' Huck testified, via video link from the Pentagon, where he is assistant deputy commandant for plans, policies and operations. 'I could see how 15 neutrals in those circumstances could be killed.'"

For General Huck, and for other commanders in Iraq, once "insurgent fire" -- or even the threat of insurgent fire -- entered the picture (and it certainly had earlier, when the American soldier was killed), then the actions reported by the Marines in that Haditha home were not just legitimate(if they reported them honestly), but exemplary. They were responding appropriately in a battlefield situation, and the death of "15 neutrals" is "not uncommon" in those circumstances.

Let's keep in mind, then, that the United States undertakes something over 1,000 patrols each day, and lately this number has surged to over 5,000 (if we also count patrols by the Iraqi military). According to U.S. military statistics, again reported by the Brookings Institute, these patrols patrols currently result in just under 3,000 firefights every month, or just under an average of 100 per day (not counting the additional 25 or so involving our Iraqi allies). Most of them do not produce 24 Iraqi deaths, but the rules of engagement our soldiers are given -- throwing hand grenades into buildings holding suspected insurgents, using maximum firepower against snipers, and calling in artillery and air power against stubborn resistance -- guarantee a regular drumbeat of mortality.

It is worth recording how these events are reported in the American press, when they are noted at all. Here, for example, is an Associated Press account of American/British patrols in Maysan province, a stronghold of the Mahdi army:

Well to the south, Iraqi officials reported as many as 36 people were killed in fierce overnight fighting that began as British and Iraqi forces conducted house-to-house searches in Amarah, a stronghold of the Shiite Mahdi Army militia.

This brief description was part of a five paragraph account of fighting all over Iraq, part of a review under the headline "U.S. and Iraqi forces Move on Insurgents." It contained brief accounts of several different operations, none of them presented as major events. There were 100 or so engagements that day, and many of them produced deaths. How many? Based on the Lancet article, we could guess that on that day -- and most days -- the incident in Amarah represented perhaps one-tenth of all the Iraqis killed by Americans that day. Over the course of June, the accumulated total probably came to something over 10,000.

During the hearing about Haditha one of the investigators addressed the larger question that emerges from the sacrifice of so many civilians to the cause of chasing and catching insurgents in Iraq. Lieutenant Max D. Frank, the first officer to investigate the deaths, characterized is an "unfortunate and unintended result of local residents' allowing insurgent fighters to use family homes to shoot at passing American patrols." Using a similar logic, First Lt. Adam P. Mathes, the executive office of the company involved, argued against issuing an apology to local residents for the incident. Mathes advocated that instead they should issue a warning to Haditha residents, that the incident was "an unfortunate thing that happens when you let terrorists use your house to attack our troops."

The Merriam Webster dictionary defines terror as "violent or destructive acts (as bombing) committed by groups in order to intimidate a population. ..." The incident at Haditha was just such a violent act, and was one of about 100 that day that Lt. Mathes hoped would intimidate the population of Haditha and other towns in Iraq from continuing to support insurgents.

Iraq by the Numbers

Sometimes, numbers can strip human beings of just about everything that makes us what we are. Numbers can silence pain, erase love, obliterate emotion, and blur individuality. But sometimes numbers can also tell a necessary story in ways nothing else can.

This January, President Bush announced his "surge" plan for Iraq, which he called his "new way forward." It was, when you think about it, all about numbers. Since then, 28,500 new American troops have surged into that country, mostly in and around Baghdad; and, according to the Washington Post, there has also been a hidden surge of private armed contractors -- hired guns, if you will -- who free up troops by taking over many mundane military positions from guarding convoys to guarding envoys. In the meantime, other telltale numbers in Iraq have surged as well.

Now, Americans are theoretically waiting for the commander of U.S. forces in Iraq, General David Petraeus, to "report" to Congress in September on the "progress" of the President's surge strategy. But there really is no reason to wait for September. An interim report -- "Iraq by the numbers" -- can be prepared now (as it could have been prepared last month, or last year). The trajectory of horror in Iraq has long been clear; the fact that the U.S. military is a motor driving the Iraqi cataclysm has been no less clear for years now. So here is my own early version of the "September Report."
